By accessing or using the ImmuneSpan website, platform, software, or any associated services (collectively, the "Service"), you ("User," "you," or "your") agree to be legally bound by these Terms of Service ("Terms") and by our Privacy Policy, which is incorporated herein by reference. These Terms constitute a binding legal agreement between you and ImmuneSpan Inc. ("ImmuneSpan," "we," "our," or "us"), a Delaware corporation.
If you do not agree to all of these Terms, you must immediately cease all use of the Service. Your continued use of the Service following any modification to these Terms constitutes acceptance of those modifications.
These Terms apply to all users of the Service, including without limitation visitors, subscribers, and any other persons who access or use the Service.
ImmuneSpan provides a general wellness education platform that delivers population-level wellness pattern analysis, educational content about biological aging research, and personalized wellness archetypes derived from publicly available population reference data (NHANES). Specifically:
The Service is powered by the Methuselah Engine V20.0.0, a machine-learning model trained on the National Health and Nutrition Examination Survey (NHANES) population dataset. The Methuselah Engine measures population-level wellness patterns — it does not produce individual clinical assessments, clinical diagnoses, or medical predictions.
All outputs of the Service — including but not limited to Population Inflammatory Age Comparison scores, archetype assignments, and Five Biological Dimension scores — are educational, population-comparison metrics intended for general wellness awareness purposes only. They are explicitly not clinical measurements, clinical diagnoses, prognoses, or treatment recommendations.
The Service is available only to individuals who are 18 years of age or older. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into a binding agreement.
The Service is intended for general consumer wellness education purposes and is expressly not intended for:
We reserve the right to refuse access to the Service to any person or entity at our sole discretion, and to terminate or suspend access for violation of these Terms or for any other lawful reason.
Tier 1 access is available without account registration. Tiers 2 and 3 require creation of an account and payment of applicable fees. When creating an account, you agree to:
You are solely responsible for all activity occurring under your account. ImmuneSpan will not be liable for any loss or damage arising from unauthorized use of your account.

All payments are processed via Stripe, Inc. ImmuneSpan does not store payment card information. Except as expressly provided in Section 5 (12-Month Wellness Score Improvement Commitment), all sales are final. Tier 3 annual subscription fees are non-refundable except as provided under the Improvement Commitment terms or as required by applicable law.
5.1 Eligibility. The 12-Month Wellness Score Improvement Commitment ("Commitment") is available exclusively to active Tier 3 subscribers who:
5.2 Refund Conditions. A full refund of the Tier 3 annual subscription fee ($199) will be issued if all eligibility requirements in Section 5.1 are satisfied and the final Wellness Score recorded in the Month 12 (or final) report shows no measurable improvement compared to the baseline Month 1 report, as calculated by the Methuselah Engine V21.0.0. "Measurable improvement" is defined as a Wellness Score increase of at least two (2) points on the 200-point scale. The $150 setup fee is non-refundable.
5.3 Limitations and Disclaimers. The Commitment is not a guarantee of any health outcome, improvement in any medical condition, reduction in disease risk, or improvement in any clinical biomarker. It is a commercial wellness engagement program. Improvements in Wellness Score reflect population-level pattern changes in educational wellness metrics and do not constitute evidence of improved clinical health status. ImmuneSpan expressly disclaims any warranty that following its educational content will produce any specific health result.
5.4 Disqualifying Events. A refund request will be denied if: the subscriber fails to meet the reporting intervals; the blood panels submitted are incomplete or outside the minimum required biomarker set; the account is in arrears or has been terminated for cause; or the subscriber has submitted more than one refund request under this Commitment.
5.5 Process. To initiate a Commitment refund request, contact us at the address provided in Section 13 with your account email and the phrase "Improvement Commitment Refund Request." ImmuneSpan will review eligibility within fourteen (14) business days and issue any approved refund via the original payment method within thirty (30) days of approval.
6.1 Tier 1 and Tier 2 (Session-Only). Blood work values entered by Tier 1 and Tier 2 users are processed in-session for the purpose of generating the requested wellness report. This data is not retained by ImmuneSpan beyond the active session unless the user affirmatively opts into Tier 3 Dashboard storage. No session data is stored server-side for Tier 1 or Tier 2 users.
6.2 Tier 3 Dashboard Storage. Tier 3 subscribers expressly consent, as a condition of activating the 12-Month Trajectory Dashboard, to the storage of their submitted biomarker values and associated report outputs in ImmuneSpan's encrypted cloud database (Supabase PostgreSQL with row-level security and AES-256 encryption at rest). This data is used solely to generate trajectory reports and is not shared with any third party except as required by law or as described in our Privacy Policy.
6.3 Research Network Participation (Opt-In Only). ImmuneSpan operates an optional Research Network program. Participation is entirely voluntary and is not required to receive any tier of service. At the time your wellness report is delivered, you may be presented with an opt-in screen offering you the opportunity to contribute de-identified data to the Research Network dataset. Participation requires a clear affirmative action — there is no pre-checked default. If you take no action, no research data is retained.
By opting into the Research Network, you consent to the following: (a) your biomarker values, wellness archetype, Wellness Age score, age range (5-year bucket), biological sex (if provided), and 3-digit ZIP code prefix are extracted and de-identified; (b) your original user_id is replaced with a one-way cryptographic hash (SHA-256 with salt) that cannot be reversed; (c) all other personally identifying information (name, email, full date of birth, exact address) is permanently destroyed; and (d) the de-identified record is stored in an encrypted AWS S3 research data store. Opting in to the Research Network constitutes a separate consent to this data processing, distinct from and in addition to your agreement to these Terms of Service. Your Research Network opt-in consent may be withdrawn at any time by contacting privacy@immunespan.com, but withdrawal cannot retroactively remove de-identified records that have already been written, as no reverse linkage to your identity is maintained.
6.4 De-identified Data Licensing. De-identified Research Network data may be licensed by ImmuneSpan to pharmaceutical companies, biotechnology companies, or academic research institutions. Any such licensing is subject to the following conditions, which ImmuneSpan commits to as a contractual obligation to Research Network participants: (a) each external recipient must operate under a documented IRB (Institutional Review Board) approval covering the specific research protocol for which the data is used; (b) the data license agreement must explicitly prohibit re-identification attempts and require destruction or return of the dataset at the conclusion of the approved research period; (c) ImmuneSpan will maintain a registry of all external data licensing agreements and will make summary information about active research uses available upon written request to privacy@immunespan.com; (d) data may not be licensed to insurance companies, employers, government agencies (except pursuant to valid legal process), or data brokers for any purpose; and (e) academic publications arising from licensed data must present findings at the population level only, with no individual-level records disclosed.
6.5 No Sale of Identified Health Data. ImmuneSpan does not sell, rent, license, or otherwise transfer any identified user health or biomarker data — data that is linked or linkable to a specific individual — to any third party for commercial purposes. We do not use identified user health data for advertising, profiling, or sale to data brokers. De-identified Research Network data (described in Sections 6.3 and 6.4 above) is not "identified" data and its licensing to approved research partners under IRB-approved protocols is not a "sale" of personal information within the meaning of applicable data protection statutes.
6.6 HIPAA-Conscious Practices. While ImmuneSpan is a general wellness platform and may not be a "Covered Entity" under the Health Insurance Portability and Accountability Act of 1996 (HIPAA), we voluntarily adopt HIPAA-aligned data security practices including: access controls and audit logging, encryption in transit (TLS 1.2+) and at rest, minimum necessary access principles, and documented incident response procedures. Research Network de-identification is performed in accordance with the HIPAA Safe Harbor method (45 CFR §164.514(b)).
6.7 User Rights. You may request deletion of your stored data at any time by contacting us at the address in Section 13. Deletion requests will be processed within thirty (30) days. Deletion of stored data will terminate your eligibility for the 12-Month Wellness Score Improvement Commitment. See Section 6.3 for the limitations on deletion of de-identified Research Network records.
6.8 No Transmission to Clinical Systems. ImmuneSpan does not transmit, share, or integrate any user-submitted data with any electronic health record (EHR) system, hospital system, insurance system, employer, or government health database.
All content, software, algorithms, models, reports, text, graphics, logos, and other materials available through the Service (collectively, "ImmuneSpan Content") are the proprietary property of ImmuneSpan Inc. or its licensors and are protected by applicable copyright, trademark, trade secret, and other intellectual property laws.
Subject to your compliance with these Terms, ImmuneSpan grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial wellness education purposes only. This license does not include the right to:
The IMMUNESPAN™ name and logo are trademarks of ImmuneSpan Inc. You may not use these marks without our prior written consent. The Methuselah Engine™ and associated scoring methodology are proprietary trade secrets of ImmuneSpan Inc.
You agree that you will not use the Service for any of the following prohibited purposes:
Violation of any prohibited use may result in immediate suspension or termination of your account, forfeiture of any refund rights under the Improvement Commitment, and may expose you to civil liability or referral to appropriate law enforcement authorities.
9.1 General Wellness Classification. ImmuneSpan is designed and operated as a general wellness product in accordance with the FDA's Final Guidance: "General Wellness: Policy for Low Risk Devices" (January 2019, Docket No. FDA-2014-D-0395). The Service does not make claims related to the detection, diagnosis, treatment, mitigation, or prevention of any disease or medical condition. The Service is not a Class I, II, or III medical device and is not subject to FDA premarket notification or approval requirements.
9.2 Nature of Outputs. The Methuselah Engine V21.0.0 measures and reports on population-level wellness patterns derived from statistical analysis of public health datasets. All outputs, including Population Inflammatory Age Comparison scores, archetype assignments, and Five Biological Dimension scores, are statistical population-comparison metrics — they are not clinical measurements, do not reflect individual clinical outcomes, and do not predict future health events for any individual. A Population Inflammatory Age Comparison indicating a younger reference group does not mean you are free from disease. A comparison indicating an older reference group does not mean you have any disease. Required disclosure: "This comparison reflects the NHANES population age group whose inflammatory biomarker pattern most closely resembles yours — it is a population reference metric, not a measure of your biological age."
9.3 No Warranty. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, COMPLETENESS, OR NON-INFRINGEMENT. IMMUNESPAN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
9.4 Healthcare Disclaimer. Nothing in the Service constitutes the practice of medicine, nursing, pharmacy, or any other licensed health profession. Always seek the advice of a qualified healthcare provider with any questions you may have regarding your health or a medical condition. Never disregard, delay, or discontinue professional medical advice because of anything you read or see in the Service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IMMUNESPAN INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, PERSONAL INJURY, OR ANY OTHER INTANGIBLE LOSS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE OR ANY CONTENT OBTAINED THROUGH THE SERVICE, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF IMMUNESPAN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IMMUNESPAN'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO IMMUNESPAN IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain types of damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by applicable law.
These Terms and any dispute arising out of or related to them or the Service shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service that cannot be resolved informally shall be subject to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with proceedings to be conducted in Delaware. Each party shall bear its own arbitration costs except as otherwise required by law. YOU HEREBY WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION PROCEEDING.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction in Delaware to protect its intellectual property or confidential information.
ImmuneSpan reserves the right to modify or update these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page and, for Tier 2 and Tier 3 subscribers, send notice to the email address associated with your account at least fourteen (14) days before the changes take effect.
Your continued use of the Service after the effective date of any revised Terms constitutes your acceptance of those revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Service and, if applicable, cancel your subscription before the effective date.
We will maintain a version history of these Terms and make prior versions available upon written request.
